Heard Mr. S.P. Pani, learned counsel for the petitioner and Mr. A. Das, learned counsel for National Highways Authority of India.

According to Mr. Pani, the petitioner is aggrieved by the inaction of the authorities in making payment of compensation though his land i.e. Plot Nos.969/1075 & 978 pertaining to Khata No.37 falling under Mouza-Lungei under panposh Tahasil in the district of Sundargarh has been acquired by the National Highways Authority for constructing National Highway No.23. He further submits that though the petitioner has filed a representation for the said purpose before the Project Director, N.H.A.I. Division (opposite party No.5) under Annexure-3 but, till date nothing has been done in the matter.

Mr. Das submits that for redressal of such type of grievances, the petitioner should have approached the Additional District Magistrate-cum-Competent Authority, N.H.A.I, NH-23 (opposite party No.3) instead of rushing to this

In such background, this Court directs the petitioner to file an appropriate application before opposite party No.3 through registered post within a period of two weeks from today along with copy of this order. In the event, such application is received, the opposite party No.3 is directed to take a decision on the same in accordance with law within a period of eight weeks from the date of receipt of such application and communicate the result of such exercise to the petitioner. 5.

Urgent certified copy of this order be granted on proper application.

Free copy of this order be handed over to Mr. Das, learned counsel for National Highways Authority of India for onward transmission and compliance.
