Heard learned counsel for the Parties.

The Writ Petition involves so many grounds alleging that there has been no proper care in making the Petitioner able to proper utilizing the lease taken and proper income.

This Court finds, there is no foundation in such allegation. It is at this stage of the matter and further looking to the lease period, this Court also finds Petitioner's term is going to expire in this month itself. Petitioner if at all sustained any loss for any negligence by any concern, it may be open for the Petitioner to undertake such exercise under any appropriate provision of law. Petitioner volunteers that there is already undertaking of fresh exercise involving fresh lease in the meantime.

Taking this Court to the representation vide Annexure-4, learned counsel for the Petitioner claims that request at the instance of the petitioner is pending before the competent authority be considered.

// 2 // Considering this limited request involved herein, this Court in disposal of the Writ Petition directs the Sub-Collector, Kendrapara-Opposite Party No.3 to look into the request of the Petitioner vide Annexure-4, if it is pending and pass appropriate order at least within a period of one week from the date of communication of certified copy of this order within three working days hence.
