This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners and the learned Additional Standing Counsel. Perused the records. 3.
This is an application under Section 438 Cr.P.C. filed by the Petitioners for anticipatory bail.

It is submitted by the learned counsel for the Petitioners that the Petitioners have no way connected in this case and have no role in the present case, but the informant has falsely lodged the present F.I.R. against the Petitioners due to previous grudge and enemity. It is further submitted by the learned counsel for the Petitioners that on perusal of the F.I.R. as well as the statements recorded under section 161 Cr.P.C. it is found that no case is made out against the Petitioners.

Considering the nature of allegations made, gravity of the offence and the fact of the case, I am not inclined to grant
// 2 // anticipatory bail to the Petitioners. However, it is directed that in the event the Petitioners surrender before the learned J.M.F.C., Basta in C.T.Case No.469 of 2022 arising out of Baliapal P.S.Case No.156 of 2022 within a period of three weeks from today and move for bail, they shall be released on bail on such terms and conditions as would be deemed just and proper by the learned Magistrate and subject to verification of criminal antecedents of similar nature against the Petitioner. It is also directed that the Petitioner shall not indulge in any criminal activities as mentioned in the F.I.R. and in the event it is fund that the Petitioner is involved in such criminal activities, this order shall stand revoked and it is open for the learned court in seisin over the matter shall proceed in accordance with law. 6.
The ABLAPL is accordingly disposed of.
