Heard Mr. B.S. Das, learned Counsel for the Petitioner and Mr. P.P. Mohanty, learned Additional Government Advocate for the State.

In compliance to the order dated 22.07.2022, Mr. P.P. Mohanty, learned Additional Government Advocate obtained the instruction and contended that since the application submitted by the Petitioner is incomplete, therefore, the same was rejected. It is also contended that only ground of rejection as has been alleged by the Petitioner that her bid was rejected because non furnishing of Bank Guarantee is not correct. Rather the Petitioner has not submitted the trace mark and as well as the details of the land. Therefore, his application was incomplete one. Consequentially the same was rejected. Not only the Petitioner's bid, but also all other bids have been rejected due to defects in each of the cases.

In view of the above, this Court is of the considered view that the stand taken by the Petitioner pertaining to non submission of Bank Guarantee is not correct. Since other requirements were there in the tender condition, which were to be complied with, but the same having not been complied with, this Court is not inclined to entertain the Writ Petition, which is accordingly dismissed.
