Heard learned counsel for the petitioner and learned counsel for the State.

Consent memo filed by authorizing Miss. D. Nanda to conduct this matter is taken on record.

The petitioner is an accused in Reamal P.S. Case No.265 of 2022 corresponding to Special G.R. Case No.25 of 2022, pending before the learned Additional District & Sessions Judgecum-Special Court, Deogarh, for offences under Sections 363/376(2)(n) of IPC and Section 6 of the POCSO Act. 5.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge-cum-Special Judge, Deogarh, by order dated 21.06.2022 in the aforementioned case, the present BLAPL has been filed. 6.

Considering the 164 Cr.P.C. statement of the victim and the period of custody since 14.06.2022 and filing of charge-sheet,

this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.

Accordingly, the BLAPL stands disposed of.
