This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.1312 of 2021, on the files of learned J.M.F.C., Chandikhole, arising out of Badachana P.S. Case No.302 of 2021, under Sections 395/34 of IPC and is in custody since 14.07.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Asst. Sessions Judge, Chandikhole, by order dated 20.07.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner submits that the coaccused has been released on bail by this Court by order dated 28.06.2022 in BLAPL No.4114 of 2022.

Taking into account the nature of allegations and the age of the petitioner and release of the co-accused, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
