This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Special G.R. Case No.85 of 2022, on the files of learned Additional Sessions Judge-cumSpecial Court under POCSO Act, Cuttack, arising out of Nischintakoili P.S. Case No.90 of 2022, under Sections 363/ 366/ 376(2)(n)/ 294/ 323/ 506/34 of IPC read with Section 6 & 12 of the POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Court under POCSO Act, Cuttack, by order dated 20.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim.

Taking into account that the petitioner is not the principal accused and he is related to the accused and considering his age, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.

Accordingly, the BLAPL stands disposed of.
