This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioners and learned counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioners for anticipatory bail.

The petitioners are seeking pre-arrest bail in connection with G.R. Case No.203-B of 2008, arising out of Kotagarh P.S. Case No.28 of 2008 pending in the court of learned J.M.F.C., Kotagarh for commission of offence punishable under Sections 147/148/149/ 427/436/435/506/380/452, I.P.C.

An oral prayer is being made by learned counsel for the petitioners that he does not want to press the bail application of the Petitioner No.12-Ramesh Patra. Accordingly, the bail application Petitioner No.12-Ramesh Patra stands disposed of as not pressed. 6.
So far as other petitioner nos.1 to 11 are concerned, considering the nature of allegation, gravity of offence and the fact
// 2 // of the case, I am not inclined to grant anticipatory bail to the petitioner nos.1 to 11. However, it is directed that in the event the petitioner nos.1 to 11 surrender before the learned court in seisin over the matter within a period of three weeks from today in the aforesaid case, they shall be released on bail on such terms and conditions as would be deemed just and proper. 7.
Accordingly, the ABLAPL is disposed of.
Urgent certified copy of this order be granted on proper application.
