This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in T.R. Case No.243 of 2022, on the files of learned District & Sessions Judge, Khordha at Bhubaneswar arising out of Bharatpur P.S. Case No.254 of 2022, under Sections 20(b)(ii)B of the NDPS Act and is in custody since 21.06.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned District & Sessions Judge, Khurda, at Bhubaneswar, by order dated 18.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the impugned order of rejection.

Admittedly seizure of the contraband (ganja) is to the tune of 12.200 kgs., which is admittedly less than the commercial quantity as prescribed.

Taking note of the same, this Court directs the petitioner to be released on bail, on such terms and conditions to be fixed by the learned Court in seisin over the matter.

Additionally, it is directed that one of the sureties shall be local sureties and other one is the immediate family member of the petitioner.

Accordingly, the BLAPL stands disposed of.
