2. Mr. B.S.Das, learned counsel has appeared for the petitioner.

3. Mr. P.K.Muduli, learned AGA has submitted the statue report wherefrom it transpires that the victim whose name we withhold for protecting her identity, has been recovered and placed in a short stay home. At the time of recovery, the victim was found with a female baby child which she claims to have given birth. Be that as it may, her statement under section 164 of the CrPC has been recorded by the local area Magistrate. In that statement she has expressed her desire to live with the in-laws, meaning there had been a marriage, according to her perception. But it appears to us that if the age recorded in the school record is believed, the victim has not attained marriageable age. If the parents are willing to take victim to their place for providing care, they may approach the Child Welfare Committee, Kendrapara. CWC after considering all the circumstances, assurance and also the paramount interest of the victim, the residency of the victim they may decide for a short or long term. But this proceeding has become infructuous with recovery of the victim.
