Heard learned counsel appearing for the parties. 2.
Filing counter affidavit, the Tahasildar Basudevpur brings to the notice of the Court that after the judgment and decree, there has been further litigation by way of execution, a C.M.P. even there is also pendency of S.L.P. However, Mr.Panda, learned Additional Government Advocate volunteers to submit that there is no stay order as of now. Besides above, this Court also finds no plausible reason in sitting over such matters except deciding such matters even in the involvement of the further development through different forums. This Court finds no plausible reason in sitting over such matters even after one writ disposal and a contempt disposal. This Court here observes a sorry state of affair in the response of the public authority to the Court's direction when Court directs, an act has to be completed within a stipulated period and if the act is not done within that period and there is even no minimum courtesy of the Public Officer to request High Court for extension of time, such action in the opinion of this Court amounts to be contempt of court for violation of
// 2 // direction of the Court. This Court hopes and expects the Chief Administrator of the State shall take care of this situation e and see that there is no disrespect to the Court's orders herein and the valuable Court's time will not be wasted in bringing writ application seeking direction to work out an action within targeted period. This Court finds pursuant to the previous order, there is personal appearance of the Tahasildar, Basudevpur-opposite party no.3, who undertakes in Court to complete the exercise at least within a period of one month but however involving parties likely to be affected. 3.
This Court disposes of the writ petition with expectation at this stage there will be a lawful disposal of the mutation case. 4.
Personal appearance of the Tahasildar, Basudevpur-opposite party no.3 is dispensed with.
