Heard learned counsel for the parties.

The Petitioner is an accused in connection with S.T. Case No. 07 of 2004 arising out of Soroda P.S. Case No. 103 of 2003 on the file of learned Addl. Sessions Judge, Bhanjanagar, Dist. Ganjam, registered for the alleged commission of offence under Sections 341/ 294/323/34 of the I.P.C. and Section 3(1)(v) of the SC/ST(PoA) Act. 4.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Addl. Sessions Judge, Bhanjanagar, Dist. Ganjam by order dated 13.07.2022, the present BLAPL has been filed 5.

Keeping in view the order of rejection passed by the learned Additional Sessions Judge, Bhanjanagar in S.T. Case No. 7 of 2004, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter to ensure the presence of the accused on each date of trial.

Additionally it is directed that one of the sureties must be immediate family member of the petitioner and petitioner shall report before the jurisdictional Police Station of the court once every week till conclusion of the trial. The report of such appearance shall be submitted to the learned court in seisin over the matter. 7.

It is needless to say that violation of any of the conditions shall entail cancellation of bail.

Accordingly, the BLAPL stands disposed of.
