Heard learned counsel for the parties.

The Petitioner is an accused in connection with G.R. Case No. 884 of 2022 arising out of Balangir Sadar P.S. Case No. 249 of 2022 on the file of learned SDJM, Balangir, registered for the alleged commission of offence under Sections 420/468/471/120-B/34 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned 1st Addl. Sessions Judge, Balangir Dist. Ganjam by order dated 16.07.2022, the present BLAPL has been filed 5.
Perused the order of rejection.

It is submitted by learned counsel for the petitioner that the petitioner is not an F.I.R. named accused. It is submitted that F.I.R. named co-accused has since been released on pre-arrest bail by this Court by order darted 21.07.2022 in ABLAPL No. 7656 of 2022, hence, it is submitted that further continuance of the petitioner is not warranted.

Taking into account the release of co-accused on pre-arrest bail and the petitioner being not a F.I.R. named accused, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned court.

Accordingly, the BLAPL stands disposed of.
