1. This matter is taken up through hybrid arrangement.

2. Heard.

3. In this Writ Petition, the petitioner challenges the letter dated 09.05.2022 wherein the opposite party No.2Registrar, Khallikote Unitary University, Berhampur came to a conclusion that the petitioner, Ex-Senior Clerk and two others namely Prasanta Kumar Satapathy, ExPrincipal I/C and Khali Charan Pradhan, Ex. Senior Clerk are the erring officials who are collectively responsible for the delay in payment of arrear family pension in favour of Laxmi Mahankuda, wife of late Prafulla Ch. Mahankuda, ExLab.

Attendant of Khakikote Autonomous College, Berhampur. He further seeks direction from this Court to the opposite party No.1-

// 2 // Secretary, Higher Education Department, Odisha, Bhubaneswar to issue instruction to the opposite party No.2Registrar, Khallikote Unitary University, Berhampur for fresh enquiry by providing him opportunity of hearing.

4. After arguing sometime, learned counsel for the petitioner states that the petitioner has submitted a representation to the opposite party No.1- Secretary, Higher Education Department, Odisha, Bhubaneswar ventilating his grievance which is pending since 15.07.2022.

In that view of the matter, without expressing any opinion on the merit of the claim of the petitioner, the opposite party No.1- Secretary, Higher Education Department, Odisha, Bhubaneswar is directed to take a decision on the representation of the petitioner and dispose of the same in accordance with law within a period of one month from the date of presentation/ submission of a certified copy of this order along with a copy of the Writ Petition.

6. Till disposal of the representation of the petitioner, Annexure-3 to the Writ Petition may not be given effect to.

7. Accordingly, this Writ Petition is disposed of.

8. Urgent certified copy of this order be granted on proper application.

9. A free copy of this order be handed over to the learned Additional Government Advocate.
