This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Lanjigarh P.S. Case No.34 of 2022 corresponding to C.T Case No.664/63 of 2022of POCSO, pending before file of learned Additional Sessions Judge-cumSpecial Court under POCSO Act, Bhawanipatna, Kalahandi, offences punishable under Section 354-C/34 of IPC read with Section 12/14 of POCSO Act and Section 66(E)/67(A) of IT Act. 4.
Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Court under POCSO Act, Bhawanipatna, Kalahandi, by order dated 04.07.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner submits that since charge-sheet has already been filed on 08.07.2022 and he is in custody since 08.06.2022, his further continuance in custody is not warranted, more so when he is not the principal accused and one Kanhu Charan Nayak is stated to have made the objectionable video, which was circulated by the petitioner. 6.
Taking into account the allegations as borne out from the case record and keeping in view the period of custody, filing of charge-sheet, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 7.
Accordingly, the BLAPL stands disposed of.
