Heard learned counsel for the parties.

The Petitioner is an accused in connection with G.R. Case No. 2434 of 2022 arising out of Jujumura P.S. Case No. 90 of 2022 on the file of learned S.D.J.M., Sambalpur, registered for the alleged commission of offence under Sections 341/306/323/34 of the I.P.C. 4.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned 1st Addl. Sessions Judge, Sambalpur, by order dated 19.07.2022, the present BLAPL has been filed 5.

Learned counsel for the petitioner submits that investigation has substantially progressed. Keeping in view the nature of accusation further continuance of the petitioner is unwarranted. 6.

Learned counsel for the State opposes the prayer inter alia on the ground of parity since the investigation is yet to be completed release of the petitioner at this stage is not called for. 7.

Taking into account the allegations being one under Section 306 of the I.P.C. and the role ascribed to the petitioner by the

investigating agency as revealed from the perusal of the case record, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 6. Additionally it is directed that petitioner shall appear before the jurisdictional Police Station of the court once every week till submission of the Charge Sheet.

It is needless to say that violation such apperance shall entail cancellation of bail.

Accordingly, the BLAPL stands disposed of.
