Heard learned counsel for the parties.

The Petitioner is an accused in connection with 2(a) CC Case No. 224 of 2022 arising out of Rayagada Excise Sadar, pending on the file of learned S.D.J.M., Rayagada, registered for the alleged commission of offence under Section 5rt2(a) of the Odisha Excise Act. 4.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Addl. District and Sessions Judge, Rayagada, by order dated 18.07.2022, the present BLAPL has been filed 5.

Taking into account the nature of allegation and punishment prescribed and the period of custody since 17.06.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
