This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Appellant as well as learned counsel for the Respondents.

This is an application under Section 14(a) of the S.C. and S.T. (PoA) Act filed by the Appellant for bail in connection with Special G.R. Case No.38 of 2021 corresponding to Chandrabhaga P.S. Case No.07 of 2021 pending before the learned Additional Sessions Judgecum-Special Judge, Nimapara for alleged commission of offence under Sections 294/376, I.P.C. read with Sections 3(1)(s)w(ii), 2(v) of the S.C. and S.T. (PoA) Act.

Learned counsel for the Petitioner does not want to press this application at this stage. However, he seeks a direction to the trial court for examination of the victim and further seeks a direction to expedite trial and to conclude the same within a period of four

// 2 // months. Accordingly, the bail application is disposed of as not pressed.

Learned trial court is directed to make endeavour for examination of the victim and to conclude the trial within a period of four months. In the event trial is not concluded within the aforesaid period from the date of production of certified copy of this order, it is open for the Petitioner to renew his prayer for bail and in such event the bail application be considered without being influenced by any other factor.

Urgent certified copy of this order be granted on proper application.
