This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is an accused in connection with G.R. Case No.217 of 2022, pending before the Court of learned J.M.F.C., Kanas, arising out of Pipili P.S. Case No.131 of 2022, for commission of offences under Sections 452/307/506 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 2nd Additional Sessions Judge, Puri, by order dated 12.07.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel that the petitioner is in custody since 10.06.2022 and since charge-sheet has already been filed on 25.07.2022, further continuance of the petitioner in custody is unwarranted

Learned counsel for the petitioner on instruction submits that the injured Rama Chandra Mallik has in the meanwhile recovered and is leading a normal life.

Considering such submission, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
