This matter is taken up through Hybrid mode.

The petitioners in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") have prayed for quashing of the F.I.R. in Bhubaneswar Vigilance P.S. Case No.27 of 2005 corresponding to T.R. No.80 of 2007 pending on the file of the learned Special Judge (Vig.), Bhubaneswar.

Learned counsel for the petitioners seeks for an adjournment of the case. However, Mr. Pani, the learned Senior Standing counsel appearing for the Vigilance Department submits that the trial of the aforesaid case is in progress and in the meanwhile twenty-one witnesses have already been examined.

In such view of the matter, this Court is not inclined to adjourn this matter further. As such, this CRLMC stands dismissed for non-prosecution, inasmuch as this matter is pending since 2014 and in the meanwhile eight months have already been elapsed.
