This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for Petitioner and learned counsel for the State-Opposite Parties.

The Petitioner is aggrieved by the 2nd show cause notice issued by the Opposite Party No.5 on 23.06.2022 in a disciplinary proceeding initiated against the Petitioner vide Proceeding No. 1 of 2017.

It is submitted that the Petitioner is facing a criminal proceeding in Sahadevkhunta P.S. Case No.268 of 2016 on similar issue.

It is submitted that the Petitioner will be seriously prejudiced if the disciplinary proceeding is finalized prior to disposal of the said criminal proceeding.

Be that as it may, the Petitioner is at liberty to submit his reply to the 2nd show cause before the said opposite Party No.5 within a period of 2(Two) weeks from today. But it is observed that no final order be passed in the said disciplinary proceeding

// 2 // till disposal of the criminal proceeding, which is pending against the petitioner in the aforesaid Sahadevkhunta P.S. Case No.268 of 2016 corresponding to C.T. No.2493 of 2016. This court further observes that the trial of the aforesaid criminal proceeding be expedited by the concerned Court in seisin over the matter.

With the aforesaid observations and directions, the WPC is disposed of.
