This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail, involving offence punishable under Section 409, I.P.C.

It is submitted by learned counsel for the Petitioner that the co-accused Premananda Nayak has been released on bail by this Court in ABLAPL No.12039 of 2018 vide order dated 07.12.2018. 5.

Considering such submission and the fact that the Petitioner is a lady, although I am not inclined to grant anticipatory bail to the Petitioner, however it is observed that, in the event the Petitioner surrenders before the learned J.M.F.C., Aul in G.R. Case No.384 of 2014 corresponding to Rajkanika P.S. Case No.165 of 2014 within a

// 2 // period of three weeks from today, the Petitioner shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper in the facts and circumstances of the case. 6.

The ABLAPL is disposed of accordingly.
