For there is already determination in exercise of power under the O.P.L.E Act, 1972 and for the own document of the Petitioner at page 7, 8 & 9, this Court finds, the application for settlement of the disputed land vide Annexure-2 is not entertainable. However, considering the request made by the learned counsel for Petitioner, this Court permits the Petitioner to withdraw this Writ Petition with liberty to pursue the remedy available under any other provision. 2.

The Writ Petition is, accordingly, disposed of as withdrawn, but with liberty as prayed for.
