This matter is taken up through Hybrid mode.

This CMP has been filed for a direction to learned Civil Judge (Senior Division) (LR & LTV), Bhawanipatna to dispose of CS No.45 of 2018 pending before him at an early date. 3.
It is submitted by Mr. Pattajoshi, learned counsel that the Petitioner is Defendant No.6 in the suit. When the suit was ready for hearing, the Plaintiffs filed an application under Order VI Rule 17 CPC and for that the matter was being delayed. However, the petition under Order VI Rule 17 CPC has already been allowed in the meantime and the matter is posted on 29th August, 2022 for office note on the consolidate plaint. It is his submission that due to dilatory tactics adopted by the Plaintiffs/Opposite Parties, hearing of the suit is being delayed and for that Defendant No.6/Petitioner is highly obliged. He, therefore, submits that a direction may be issued to hear the suit expeditiously without granting unnecessary adjournment. 4.
Taking into consideration the innocuous nature of prayer made by learned counsel for the Petitioner, this Court disposes of the CMP with an observation that the parties to the suit are
// 2 // expected to cooperate learned trial Court for expeditious disposal of the suit. Learned trial Court shall also take care that parties should not take unnecessary adjournments in the matter and make an endeavour to dispose of the suit in accordance with law.

With the observation as aforesaid, the CMP is disposed of.
Issue urgent certified copy of the order on proper application.
