Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel Mr. N.P. Samal and associates have filed Vakalatnama on behalf of the informant. Names of counsel be reflected in the file as well as in the cause list. 4.

The petitioner is an accused in Spl. G.R. Case No.40 of 2022, pending in the file of learned Additional Sessions-cum-Spl. Court (under POCSO Act), Sambalpur, arising out of Hirakud P.S. Case No.20 of 2022, offence under Sections 376(2)/366/363 of IPC read with Section 6 of the POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions-cum-Spl. Court (under POCSO Act), Sambalpur by order dated 21.07.2022 in the aforementioned case, the present BLAPL has been filed. 6.

Perused the 164 Cr.P.C. statement.

Learned counsel for the informant on instructions submits does not want to oppose the prayer for bail.

Taking note of the same and considering the 164 Cr.P.C statement, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
