This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Chandiposh P.S. Case No.23 of 2022 corresponding to G.R. Case No.295 of 2022, pending before the learned S.D.J.M., Bonai under Section 307 of IPC. 5.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Bonai, by order dated 19.07.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the State on instruction submits that charge-sheet has already been filed on 28.07.2022. 7.

Learned counsel for the petitioner submits that in view of the submission of the charge-sheet, further continuance of the petitioner in custody is unwarranted.

It is further submitted by the learned counsel for the petitioner relying on affidavit which is on record of the injured Sibanath Oram that since the matter has been amicably settled, petitioner may be enlarged on bail.

Taking note of such submission, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

The learned Court below is called upon to record the statement of Sibanath Oram regarding veracity of the claim that the matter is amicably settled and if it comes to the fore that such settlement has in fact not taken place, this order shall stands recalled without any further reference of this Court. 10.

Accordingly, the BLAPL stands disposed of.
