This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.43 of 2022, pending in the Court of the learned Additional District & Sessions Judge-cum-Special Court under POCSO Act, Phulbani, arising out of Sarangada P.S. Case No.59 of 2022, for alleged commission of offences under Sections 417/376(2)(a)/376(2)(n)/376(2)(i)/313/201 of IPC read with Section 4(2) of POCSO Act.

Being aggrieved by the rejection of her application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge-cum-Special Judge (POCSO), Phulbani, by order dated 22.07.2022 in the aforementioned case, the present BLAPL has been filed.

There is no appearance on behalf of the informant/victim when the matter is called.

Learned counsel for the petitioner submits that in the meanwhile, the victim has been examined as P.W.1. 7.

The statement of the said victim is produced for perusal. 8.

Taking into account the statement of the victim, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 9.

Accordingly, the BLAPL stands disposed of.
