This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Mr. B.N. Satpathy has entered appearance on behalf of the injured. The Vakalatnama along with the affidavit filed by the injured/victim is taken on record. A copy thereof has been served on learned counsel for the State.

The petitioner is accused in Baranga P.S. Case No.60 of 2022 corresponding to G.R. Case No.803 of 2022, pending in the file of learned J.M.F.C®, Cuttack under Sections 294/326/307/285/506 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned J.M.F.C®, Cuttack, by order dated 13.07.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the recitals in the affidavit filed by the injured and keeping in view the submissions made across the bar, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. The memo indicating that the case committed to the Court of Sessions is taken on record.

Accordingly, the BLAPL stands disposed of.
