This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Brajarajnagar P.S. Case No.180 of 2022 corresponding to C.T. Case No.1447 of 2022, pending in the file of learned S.D.J.M., Jharsuguda under Section 399/402 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Jharsuguda by order dated 19.07.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the State on instruction submits that charge-sheet has been filed on 20.07.2022.

Learned counsel for the petitioner submits that since charge-sheet has already been filed and the injured is leading
normal life after being discharged from the hospital, further continuance of the petitioner in custody is unwarranted. 9.
Taking into account that the period of custody from 05.07.2022 and filing of the charge-sheet, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Additionally, it is directed that one of the sureties shall be immediate family member and that he shall appear before the jurisdictional police station once every week till conclusion of the trial. Report of such appearance shall be submitted to the Court and violation of any condition shall entail cancellation. 11.
Accordingly, the BLAPL stands disposed of.
