This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order of cognizance dated 24th February, 2014 passed by the learned J.M.F.C., Jajpur Road in 2(C)C.C. No.11 of 2014, issuance of process in the said complaint case as well as the entire proceeding.

Heard learned counsel for the parties.

It is stated that the issue involved in this Criminal Misc. Case is squarely covered by the decision of this Court in the case of Odisha Mining Corporation Ltd. v. State of Odisha and

// 2 // others [CRLMC Nos.1923 & 1925 of 2018 disposed of on 26th August, 2019]. It is thus stated that this Criminal Misc. Case may also be disposed of in terms of that decision. The same is not disputed by the learned counsel for the State. 5.

Considering the aforesaid submission, the CRLMC is allowed in terms of the decision rendered in the aforesaid Criminal Misc. Cases and consequently the criminal prosecution launched against the Petitioner stands quashed. 6.

However, liberty is given to the State to file a duly constituted complaint, if so desired by the State. (S. Pujahari) Judge DA
