This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioners for anticipatory bail, involving offence punishable under Sections 341/294/323/307/506/34, I.P.C. read with Section 7 of Criminal Law (Amendment) Act, 2013.

Considering the nature of allegation against the Petitioners, background of the case and the circumstances involved, I am inclined to release the petitioners on anticipatory bail, and accordingly it is directed that, in the event of arrest, the Petitioners shall be released on bail by the Arresting Officer on such terms and conditions as would be deemed just and proper in the facts and circumstances of the case, in connection with Sadar P.S. Case
// 2 // No.655 of 2021 corresponding to G.R. Case No.2823 of 2021 pending in the Court of learned J.M.F.C. (R), Cuttack, with the further conditions that the Petitioners shall make themselves available for interrogation/investigation by the I.O. as and when required and also they shall not threaten, terrorise or harass the prosecution witnesses, the Informant or his family members in any manner whatsoever.
Violation of any of the conditions shall entail cancellation of bail of the Petitioner.

The ABLAPL is disposed of accordingly.
