Heard learned counsel for the Parties.

It appears, on the selfsame ground, the representation of the Petitioner is pending at Annexure-8. This Court finds, the said representation made directly to the Chief Secretary of the State is not permissible at this stage.

Considering the submission of Mr.Ghosh, learned Additional Government Advocate, the Secretary is the Competent Authority to take such decision but however involving the Collector of the concerned district.

In the circumstance, while declining to allow the prayer of the Petitioner in the present scenario, this Court however permits the Petitioners to make a representation to the Competent Authority with
// 2 // a copy to the Collector of the concerned district for their taking joint decision involving such matter.
