Heard learned counsel for the Parties.

The Writ Petition has been filed with the following prayer:- "(i) Directing the Opp. Parties to recast the final gradation list of ADSWOs under Annexure-5 by placing the petitioner above the reserved candidates Opp. Party Nos.3 to 5 in the gradation list of ADSWOs following the catch up principle and on that basis consider the case of the petitioner for his promotion to the rank of District Social Welfare Officer with effect from the date of promotion of the Opp.party No.3 with all consequential service and financial benefit as the petitioner has been discharging the duty in the post of DSWO as an in charge officer".

He further submits that through highlighting his grievances, the petitioner has filed a representation on 23.12.2020 under Annexure-6 to the Writ Petition before the opposite party No.2 but till date nothing has been done in the matter. In such

// 2 // background, he prays that a direction be issued to opposite party no.2 to take a decision on the above noted petition within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs opposite party No.2 to take a decision on the above noted petition in accordance with law within a period of one month from the date of production of certified copy of this order and communicate the result of such exercise to the petitioner. It is further observed that any decision is taken in the meantime shall be subject to the final decision be taken by the said opposite party on Annexure-6.
