This matter is taken up through hybrid mode.

This contempt application has been filed alleging noncompliance of the order dated 27th June, 2022 passed in W.P.(C) No.14377 of 2022.

Along with other directions, this Court has directed the Petitioner to submit an application to the Financer-Opposite Party for supply of the outstanding dues to the Petitioner. It is fairly concedes by Mr. Das, learned counsel that the Petitioner has not submitted said application to the Financer for supply of the outstanding dues. However, a statement account was supplied by the Petitioner at Annexure-5, which was much prior to the date of the order.

In that view of the matter, this Court is of the considered opinion that since the Petitioner has not complied with the direction to be performed by him, the allegation of noncompliance of the order by the Opposite Party does not arise, as
// 2 // direction to accept 50% of the total outstanding loan dues and release of the vehicle was consequential to the action of the Petitioner, more fully, stated in the aforesaid order. 5.
Accordingly, this CONTC is dropped.
Urgent certified copy of this order be granted on proper application.
