This matter is taken up through Hybrid mode.

Plaintiffs/Petitioners in this CMP pray for a direction for early disposal of CS No.3141 of 2011 pending before learned Civil Judge (Senior Division), Jajpur Road.

It is submitted by Mr. Panda, learned counsel that pleadings in the suit are complete and the matter is ready for hearing. There is also no legal impediment for early disposal of the suit. But learned trial Court is not proceeding with the matter and granting adjournments liberally for which the Plaintiffs/Petitioners are seriously prejudiced. 4.

Submission of learned counsel for the Petitioners and perusal of record do not give a clear picture about the status of the suit. It is also not clear, whether there is any legal impediment for early disposal of the suit or not. 5.

In view of the above, this Court is not inclined to entertain the prayer made by learned counsel for the Petitioners at this stage. It is, however, observed that when the matter becomes ready for hearing, Plaintiffs/Petitioners will be at

// 2 // liberty to move learned trial Court by filing appropriate application for hearing of the suit stating the grounds therein and in that event learned trial Court may consider the said petition in accordance with law and proceed with the matter accordingly.

Issue urgent certified copy of the order on proper application.
