This matter is taken up through hybrid arrangement (virtual/physical mode).

The Petitioner is Exclusive Privilege Holder of a licence of Balisira OS Main Shop along with permission to operate the branch shop at Kendupadar, in the District of Ganjam for the excise year 2022-2023.

3. By filing the present Writ Petition, challenge is laid to the notice dated 19th July, 2022 issued by the Collector, Ganjam notifying the settlement of the licence for Balisira OS main shop through the lottery system to be held on 6th August, 2022 for the remaining period of the excise year 2022-2023 upon cancellation of the licence of the petitioner for the same shop vide order dated 21st May, 2022.

At the time of hearing, learned counsel for the petitioner prays for permission to withdraw the Writ Petition in view of the order of cancellation dated 21st May, 2022 having been set aside by this Court vide an order passed today itself in W.P.(C) No.18616 of 2022. Mr. Samantaray concedes the aforesaid factual position.

5. In view of the above, the Writ Petition is dismissed as infructuous.
