Petitioner in this CMP seeks to assail the order dated 16th July, 2022 (Annexure-4) passed by learned 3rd Additional Senior Civil Judge, Balasore in CS No.282 of 2010, whereby an application filed by Defendant No.6/Petitioner with prayer not to pass any adverse order till disposal of TRP(C) No.3 of 2021 pending before learned District Judge, Balasore, is rejected. 3.

In course of hearing, Mr. Samal, learned counsel for the Petitioner submits interest of justice will be best served if the Petitioner files appropriate application for stay of further proceeding in CS No.282 of 2010 before learned District Judge, Balasore in TRP(C) No.3 of 2021, which has been filed for transfer of the suit and analogous hearing of the same with probate proceeding. He, therefore, prays for withdrawal of the CMP. 4.

Accordingly, the CMP stands disposed of as withdrawn. 5.
