This matter is taken up through Hybrid Arrangement Order No.

(Virtual/Physical Mode).

This is an application under Section 439 Cr.P.C. filed by the Petitioner for bail in connection with Balliguda P.S. Case No.113 of 2021, corresponding to C.T. Case No.36 of 2021, pending in the file of learned Special Judge-cum-Additional Sessions Judge, Balliguda, Kandhamal, for commission of alleged offences under Sections 20(b)(ii)(C)/25/29 of N.D.P.S. Act.

Heard learned counsel for both the parties. Perused the F.I.R., Case Diary as well as statement of the Informant. 4.

Learned counsel for the Petitioner submits Petitioner is languishing in jail custody since the date of his arrest, i.e. 16.07.2021. It is further submitted that after being arrested by the police personnel, the present Petitioner moved for bail before the trial court, which was subsequently rejected vide order dated

// 2 // 19.07.2021. During pendency of the bail application, charge-sheet has been submitted on 09.01.2022.

In such view of the matter, learned counsel for the Petitioner is directed to move the court below after filing of the charge-sheet. Accordingly the bail application is disposed of as withdrawn with liberty to move the court below after filing of charge-sheet. In such event, the trial court shall consider the same on its own merits and in accordance with law without being influenced by anything. 6.

Issue urgent certified copy of this order on proper application.
