This matter is taken up through hybrid arrangement (virtual/ physical) mode.

Learned Counsel for the Petitioner submits referring to the affidavit filed by the Informant and the Victim, which are on record submits that in view of the averments made therein, the prayer for grant of anticipatory bail to the Petitioner merits acceptance.

Learned Counsel for the State submits that as yet the statement of the Victim has not been recorded. Learned Counsel for the Informant and Victim submit that the Victim is ready and willing to appear on any date at the Police Station and give her statement as also the statement under section-164 Cr.P.C. if so required.

Taking into account the submissions above, it is observed that the Victim may appear on 21st December, 2022 before the IIC, Beltukuri P.S. in the District of Nuapada for the needful.

As an interim, it is directed that the Petitioner shall not be arrested in connection with Beltukuri P.S. Case No.16 of 2018 corresponding to C.T. Case No.136 of 2018 pending on the

// 2 // file of learned S.D.J.M., Nuapada till the next date of listing subject to condition that Petitioner will cooperate with the investigation as and when required for the purpose. 6.

The matter be listed on 6th January, 2023.

Issue urgent certified copy as per rules.
