This matter is taken up through hybrid mode.

The Petitioner in this writ petition seeks for a direction for early disposal of M.A.C. Case No.1364 of 2018 pending before learned 1st Additional District Judge-cum-M.A.C.T. Cuttack.

It is submitted by Mr. Nayak, learned counsel for the Petitioner that till date neither the owner nor the Insurers have filed their written statement.

In that view of the matter, the prayer for early disposal of M.A.C. Case No.1364 of 2018 cannot be entertained at this stage. However, it is observed that if the written statement is not filed within the stipulated time as directed by learned Tribunal, coercive measure may be taken against the defaulting party and learned Tribunal is at liberty to proceed with the matter in accordance with law.

The writ petition is accordingly disposed of. Urgent certified copy of this order be granted on proper application.
