This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in G.R. Case No.61 of 2022 pending in the file of learned J.M.F.C., S. Rampur, arising out of Rampur P.S. Case No.43 of 2022, for commission of offence under Section 395 IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Sonepur by order dated 12.07.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the Petitioner that the co-accused similarly circumstanced has been released on bail by order dated 27.09.2022 in BLAPL No.6989 of 2022.

Learned counsel for the State opposes the prayer for bail of the Petitioner.

Considering the release of the co-accused who is prima facie similarly circumstanced, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Taking into account the criminal proclivity of the Petitioner, as stated at the Bar, this Court directs that the Petitioner shall appear before the jurisdictional police station of the Court in seisin over the matter once every 15 days till conclusion of the trial. The date and time to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
