This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in C.T.(S) Case No.67 of 2022 arising out of G.R. Case No.335 of 2022 corresponding to Athmallik P.S. Case No.89 of 2022, pending in the file of learned Additional Sessions Judge, Athmallik, under Sections 376(1)/376(2)(n)/506 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Athmallik by order dated 19.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement.

Considering the tenor thereof and taking into account that the petitioner is in custody since 10.04.2022 and charge-sheet has

already been filed on 27.05.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
