This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Gopalpur P.S. Case No.107 of 2022 corresponding to G.R. Case No.1229 of 2022, pending in the Court of learned S.D.J.M., Berhampur, under Sections 420/465/467/468/34 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge, Berhampur by order dated 19.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Relying on the order passed dated 16.08.2022 relating to co-accused Santosh Kumar Dash in BLAPL No.7085 of 2022, the petitioner seeks release inter alia on the ground of parity.

Taking into account the role ascribed to the petitioner and release of the co-accused, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
