This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Kesinga P.S. Case No.205 of 2022 corresponding to C.T. Case No.196 of 2022, pending in the file of learned J.M.F.C., Kesinga, under Sections 498-A/306 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Bhawanipatna, by order dated 22.07.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner submits that he is in custody since 20.05.2022 and since charge-sheet has already been filed on 30.06.2022 inter alia under Section 306 of IPC, further continuance of the petitioner in custody is unwarranted.

Learned counsel for the State opposes the prayer for bail inter alia relying on the statement of one Padmini Bhoi. 7.

Considering the materials on record and taking into account that charge-sheet has already been filed and the period of custody, this Court directs the petitioners to be released on bail on such terms to be fixed by the Court in seisin over the matter. 8.

Accordingly, the BLAPL stands disposed of.
