Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.03 of 2019, pending on the file of learned Additional Sessions Judge-cum-Judge Special Court Deogarh, for commission of alleged offences under Section 376(2)(n)/363/366/294/506/34 of IPC read with Section 6 of the POCSO Act read with section 3(1)(r)/3(2)(v)(va) of SC & S.T. (PoA) Act and is in custody since 21.04.2022. 3.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cum-Spl. Judge, Deogarh by order dated 13.05.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner is permitted to withdraw the bail application with liberty to renew his prayer before the leanred Court below which shall be considered on its own merit

without being prejudiced by the earlier rejection order passed or by the withdrawn of this application by the petitioner. 5.

Accordingly, the BLAPL stands disposed of.
