This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.178 of 2022, pending on the file of learned J.M.F.C., Gondia, arising out of Gondia P.S. Case No.96 of 2022, for commission of alleged offences under Section 395 of IPC and is in custody since 13.06.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Dhenkanal by order dated 23.07.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that the petitioner has not been identified in T.I. Parade and co-accused have since been released on bail by the learned Court in seisin by
order dated 12.10.2022 in BLAPL No.362 of 2022 and order dated 22.10.2022 in BLAPL No.417 of 2022.

Taking into account the submission that the petitioner is similarly circumstanced with the co-accused, this Court directed the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
