The petitioners in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") have prayed for quashing of the F.I.R. in Industrial Nisha P.S. Case No.227 of 2013, corresponding to G.R. Case No.2228 of 2013, pending on the file of the learned S.D.J.M., Angul. 3.

Heard the learned counsel for the petitioners and the learned counsel for the State, so also the learned counsel for the opposite party no.2.

Since the F.I.R. allegation discloses a cognizable offence, this Court is not inclined to entertain this petition, more so when the status of the investigation is also not known.

// 2 // Hence, this CRLMC stands dismissed. Interim order dated 27.06.2014 passed by this Court stands vacated. 5.

However, this Court observes that the petitioners, if so aggrieved, may challenge the order of cognizance if chargesheeted and proceeded in the case, and case is pending for framing of charge.
