This matter is taken up through hybrid mode.

This writ petition has been filed seeking for a direction to the Collector and Chairman, District Level Land SubCommittee, Cuttack-Opposite Party No.5 to make an enquiry and recommend the Chief Administrator, Shree Jagannath Temple Administration, Puri for sale of the land in question to the Petitioner.

Mr. Satapathy, learned counsel appearing for Shree Jagannath Temple Administration, Puri submits that in spite of direction of this Court, a copy of the writ petition has not been served on him. Hence, he could not take instruction in the matter.

On instruction, Mr. Mishra, learned Additional Standing Counsel submits that the case of the Petitioner was considered by the District Level Land Sub-Committee. On enquiry, it was found that the Petitioner was not in possession over the land in
// 2 // question, i.e. Plot No.180. Niali Public School is in possession over the suit land having its building over the same. Hence, the case of the Petitioner was rejected and was informed to the Administrator (Development), Shree Jagannath Temple Administration, Puri-Opposite Party No.3.

In view of the submissions made by learned counsel for the parties, nothing remains to be adjudicated in this writ petition.

Accordingly, this Court holding that prayer made in the writ petition cannot be granted disposes of this writ petition. Urgent certified copy of this order be granted on proper application.
