This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the criminal proceeding in G.R. Case No.370 of 2013, arising out of Kankadahad P.S. Case No.40 of 2013, pending in the court of S.D.J.M., Kamakshyanagar.

Heard the learned counsel for the Petitioner and the learned counsel for the State-Opposite Party No.1. No one appears on behalf of the Opposite Parties No.2 and 3 in spite of sufficiency of notice on them.

Considering the facts and submissions made, especially the offence was committed on a child of 12 years of age, as placed by the learned counsel for the State and also the statement recorded under Section 164 of Cr.P.C., I am not
// 2 // inclined to quash the aforesaid proceeding on the ground that both the Petitioner and victim are residing as husband and wife presently.

Accordingly, the CRLMC stands dismissed.
