Heard learned counsel for the Parties.

The Writ Petition involves the following prayer :- "The Petitioner therefore prays that the Hon'ble Court would be pleased to admit the writ application, issue notice to the Opp.Parties and further be pleased to direct the Opp.Party Nos.1 and 2 to take immediate steps for disposal of the Revision Case No.103/16 pending before the Court of learned Additional, Commissioner, Settlement and Consolidation, Balasore or further be pleased to direct for transfer of the above Revision to the Court of the Opp.Party No.2 and pass such other order/orders, direction/directions as the Hon'ble Court may deem fit and proper in the interest of justice."

This Court considers it to be a serious allegation of nondisposal of 36 of OHC & PFL Proceeding over six years for nonavailability of Officer concerned. Finding long delay in disposal of such matter and recording the statement of Mr.Panda, learned AGA that in fact there is no Officer joined to undertake such exercise, this

// 2 // Court in disposal of the Writ Petition in a way to find resolution of the dispute permitting the Petitioner to file an application for transfer of the proceeding to be heard by any other competent authority before the Member, Board of Revenue within fifteen days, as undertaken. In that event, the Member, Board of Revenue shall undertake the exercise of passing order transferring the proceeding involved to any other Competent Authority at least within two weeks thereafter.
